This Website is provided “as is,” with all faults, and Jazzmin Jayde express no representations or warranties, of any kind related to this Website or the materials contained on this Website. Also, nothing contained on this Website shall be interpreted as advising you.

 

Article 4 - Fees / payment for in person services

Cash, Cash App (Square), PayPal and Vanilla/OneVanilla Visa/Mastercard are acceptable forms of payment at this time. The terms are payment up front at the beginning of any in person meeting and prior to approval and logins for membership and any subscriptions. No trades of services and/or goods will be accepted as payment.

Outcall - Should you wish to meet Jazzmin outside of her home/workspace, advance deposit, as well as advance payment of all travel expenses may be requested. The balance of payment shall be payable in cash to Jazzmin at the time of her arrival..

 

Article 5 - Cancellation / no-show policies

1. Cancellations where a deposit is required:

   1. In case of cancellation made by Jazzmin, your advance deposit will be 100% reimbursed via PayPal or the sum will be held for 3 months in anticipation of another date.  After this period has elapsed and without formal instructions by you in writing, your deposit is no longer reimbursable. Hotel bookings including deposits and prepayments on a room, airline or train tickets or other travel expenses that cannot be either refunded, exchanged or modified are non-reimbursable.

   2. In case of cancellation made by you, your advance deposit is non-reimbursable but will be held for 3 months in anticipation of another date. After this period has elapsed and without formal instructions by you in writing, your deposit is no longer reimbursable. Hotel bookings including deposits and prepayments on a room, airline or train tickets or other travel expenses that cannot be either refunded, exchanged or modified are non-reimbursable.

2. Cancellations where a deposit is not required.

   1. In the presence of Jazzmin. If you are meeting Jazzmin in her home area, if for any reason you feel she is not suited for you, you have the right to cancel the date within the first 10 minutes in which case  you will be asked to give Jazzmin $100 for her time spent preparing for the date. If Jazzmin is traveling to you, you will be asked to pay Jazzmin $100 or her travel expenses whichever is greater.

   2. Should Jazzmin wish to cancel the date for any reason, the payment will be prorated based on actual time Jazzmin spent with you. You will be immediately reimbursed for any outstanding balance (exceptions stated below) or balance can be held for 3 months in anticipation of another date. After this period has elapsed and without formal instructions by you in writing, your balance is no longer reimbursable.

 

Exceptions: If the cancellation is due to your misconduct, the full agreed amount is due and no refund will occur. Misconduct includes but is not limited to endangering the life/health/well-being of Jazzmin, very poor hygiene, intoxication with alcohol and/or drugs, non-compliance with any agreement made with Jazzmin, false information provided by you in order to end the appointment, false information provided by you during the screening process, an appointment made with the express purpose of violating the privacy of Jazzmin and/or harming her, threats of physical harm made to Jazzmin, verbal and/or physical abuse such as hitting, kicking, holding down, grabbing, pulling hair, yelling at her, belittling her, attempts at humiliating her or otherwise harassing, libelous, defamatory, deceptive or fraudulent, aggressive behavior towards Jazzmin, non-compliance with Jazzmin’s rules during date.

 

Article 6 - Subscriptions, downloading digital content and webcam/text services

For subscriptions, such as membership, that automatically renews, your credit/debit card or PayPal account will automatically be charged at the end of the 90- ,180- or annual period you enrolled in unless notified by you in writing at least 7 (seven) days prior to renewal.

 

For digital content including but not limited to photographs and video, there are no refunds once the content has been downloaded unless it is clear content is not what you ordered or file has become corrupted once downloaded. In such cases, you will forfeit any rights to passwords to locked digital content once you have received the refund. Please allow up to 7 (seven) days to process refund.

 

For webcam/telephone services your refund will be prorated to any actual time spent with Jazzmin. Refunds are not possible.
 

Article 7 - Limited Liability

In no event shall Jazzmin Jayde, nor any of its officers, directors and employees, shall be held liable for anything arising out of or in any way connected with your use of this Website whether such liability is under contract.  Jazzmin Jayde, including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

 

Article 5 - Indemnification

You hereby indemnify to the fullest extent Jazzmin Jayde from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

 

Article 6 - Severability

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

 

Article 7 - Variation of Terms

Jazzmin Jayde is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.

1. Assignment

The Jazzmin Jayde is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

1. Entire Agreement

These Terms constitute the entire agreement between Jazzmin Jayde and you in relation to your use of this Website, and supersede all prior agreements and understandings.

1. Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of the State of CA, and you submit to the non-exclusive jurisdiction of the state and federal courts located in CA for the resolution of any disputes.
